TCPA & Outreach Compliance Agreement

Why this document exists

Telemarketing law carries penalties up to $1,500 per call or text. This agreement sets out how AskLily and its agents stay on the right side of the TCPA, the Telemarketing Sales Rule, CAN-SPAM, and state telemarketing and do-not-call laws. Accepting it is a condition of using the Platform.

The architecture

• Consented leads: consumers who submit AskLily forms give prior express written consent to calls, texts, and emails, including AI-assisted technology. Platform-automated messages go only to these leads.
• Cold prospects: reached only through PowerDial's guarded lane - manual dialing by you, from your own phone, after the number passes federal/state DNC and litigator screening no older than 31 days, only 8am-9pm in the consumer's local time.
• Cold converts (verbal consent only): receive no automated marketing; you personally handle all outreach until they have an application in motion.
• Email: sent under CAN-SPAM with accurate identity, a physical postal address, and a working unsubscribe honored organization-wide.

Your obligations

• Manual dialing only. No autodialers, no prerecorded or artificial-voice messages, no bulk texting tools, ever, against Platform data.
• Identify yourself, AskLily, and the purpose of the call promptly on cold calls.
• Honor every opt-out instantly and permanently: tap Do Not Call, and never work around a suppression.
• Respect calling hours and any state-specific rules for states you dial.
• Use only your registered numbers and platform email addresses for customer contact so records stay complete.
• Report any complaint, demand letter, or regulator contact related to your outreach to AskLily within 48 hours.

AskLily's obligations

• Maintain the internal do-not-call list and honor requests organization-wide within legally required timeframes.
• Screen cold-callable records against the federal registry, available state registries, and known-litigator lists on at least a 31-day cycle.
• Keep consent records, disposition logs, and message logs suitable for regulatory inquiry.
• Provide training materials (the Platform guide) and enforce this agreement evenly.

Consequences

Outreach outside these rules is unauthorized, outside the scope of your relationship with AskLily, and grounds for immediate termination. You bear responsibility for violations you commit, as set out in the Indemnification Agreement.
